Terms & Conditions

These Terms and Conditions (“Ts&Cs”) form an agreement between you and the person or business identified as “We”, “Us” or “Our” in the Schedule (“we, us, our”).

If you are under 18 years of age, your parent or legal guardian must read and agree to these Ts&Cs on your behalf. In this case, references to “you” include both you and your parent or legal guardian, where applicable.

These Ts&Cs apply when you purchase or use any products and/or services provided by us. Please read them carefully, together with any additional terms, policies, rules or guidelines published on our Website or otherwise provided to you from time to time.

By booking a consultation, making a payment, or downloading a resource from this website, you agree to the terms set out below.

Your responsibility

To get the most from your consultations, and to keep them safe and effective, you agree to:

•      be on time for your consultations;

•      be courteous and respectful toward our practitioners at all times;

•      complete any intake and follow-up documentation we require, and provide accurate and complete information about yourself, or your child if you're a parent or guardian completing it on their behalf, including current medical conditions, known allergies, food intolerances, medications or supplements you're taking and any change in dosage, recent vaccines, whether you're vegan or vegetarian, pregnant, breastfeeding or trying to conceive, and anything else relevant to your care;

•      keep that information updated as your circumstances change;

•      deal with us in good faith; and

•      comply with these Terms and all applicable laws.

Scope of Practice and Professional Disclaimer

Our services provide nutritional, dietary and lifestyle guidance based on your history, symptoms and goals. They are educational and supportive in nature and are not a substitute for medical diagnosis, medical treatment, or emergency care.

•      We do not diagnose disease, prescribe medication, or replace the advice of your GP, specialist or other registered health practitioner.

•      You should continue to see your GP or specialist for diagnosis, monitoring of existing conditions, and medication management, and should tell them about any significant dietary or supplement changes.

•      If you are experiencing a medical emergency, please call 000 or attend your nearest emergency department.

•      Recommendations are based on the information you provide. Incomplete or inaccurate information may affect the appropriateness of advice given.

•      Health outcomes vary depending on your individual situation, environment and other factors beyond our control, so we don't guarantee particular results, such as resolution of a specific symptom or condition, from our services or recommendations.

Nothing in this document limits any consumer guarantee that cannot be excluded under the Australian Consumer Law.

 Clients Under 18 and Consent for Minors

Some of our services support teenage clients, including through puberty and menarche. Where a client is under 18:

•      A parent or legal guardian must provide written consent before the first consultation, and must be reachable during online sessions for younger or less independent teenagers.

•      For clients under 14, a parent or guardian must be present for the full consultation alongside the client, rather than simply reachable.

•      A parent or guardian is responsible for the accuracy of health information provided and for payment of fees.

•      For clients aged 15 - 17, we may, at our discretion, request that a parent or guardian be present for all or part of a session.

•      Information shared by a minor client is generally kept confidential from other family members, except where we're concerned about the client's safety or required by law to disclose it.

Payment Terms

•      Fees for each appointment type are shown at the time of booking and are payable in Australian dollars.

•   A deposit is due at the time of booking. An invoice for the remaining balance is sent after your appointment and is expected to be paid within 24 hours.

•      If a private health fund rebate applies to your session, you're responsible for claiming this directly with your fund. A rebate is not guaranteed and depends on your individual policy.

•      Overdue invoices may incur a follow-up administration fee, and ongoing non-payment may result in future bookings being declined until the account is settled.

•      We may change our fees from time to time, and will let you know before they apply to a booking you've already made.

Cancellation Policy

•      We ask for at least 24 hours' notice to cancel or reschedule an appointment.

•    Cancellations with less than 24 hours' notice will result in the deposit being forfeited. Consultations missed without notice will be charged in full.

•      If we're unable to attend a scheduled consultation, we'll let you know in writing and refund any fees already paid for that session.

This policy does not affect any right you have under the Australian Consumer Law to a refund, repair or resupply if a service is not provided with due care and skill.

Products and Supplements

Some consultations may include recommendations for supplements or other products, which may be ordered through a third-party dispensary such as Vital.ly.

•      We're not responsible for orders placed directly with third-party suppliers, and by ordering through them you agree to their own terms and conditions.

•      Some products may contain allergens, such as nuts, gluten or dairy, or ingredients that aren't suitable during pregnancy or alongside certain conditions or medications. Please check the ingredient list and speak with us before purchase if you're unsure.

•     If you experience any adverse reaction, including an allergic reaction, discontinue use immediately and seek medical advice. Please notify us as soon as practicable and provide details of the reaction.

•     You are responsible for reviewing product ingredients and consulting the manufacturer or a healthcare professional before use, particularly if you have known allergies, sensitivities or pre-existing conditions.

•     To the extent permitted by law, including the Australian Consumer Law, we are not liable for adverse reactions, injury or loss arising from product use. Nothing in these Terms excludes or limits any rights or remedies that cannot legally be excluded.

Free Downloads and Educational Resources

Guides, recipes, meal plans or other resources made available for free download on this website are:

•      General information only, not a personalised treatment plan.

•      Not to be used to diagnose or treat any health condition on their own, or in place of individualised guidance from Quadrants of Health or another qualified practitioner.

•      Owned by Quadrants of Health, and provided for your personal, non-commercial use only.

Intellectual Property

All content on this website and provided through our services, including written guides, meal plans, recipes, protocols, graphics, and the Quadrants of Health logo, is property of Quadrants of Health.

•      You may not copy, reproduce, resell, distribute or publish this content, in whole or in part, without our prior written permission.

•      You may keep and personally use resources provided to you as a client.

•      Testimonials or feedback you give us may be used on our website or social media in line with our Privacy Policy, and we'll seek your permission before attributing anything identifiable to you.

Confidentiality

Your access to our services, consultations and resources is for your personal use only. You agree not to distribute, publish, duplicate, copy, sell or share any part of them, or use them for commercial purposes or your own financial gain.

This doesn't limit you from sharing your results, recommendations or records with your GP or other healthcare providers, which we encourage.

Content Policy

Where clients or members of the public interact with our website, social media or comment sections, we expect communication to be respectful. We remove content that is abusive, discloses another person's private health information, promotes unsafe practices, or is defamatory, and we act on any request to remove such content promptly.

Content we publish, including blog posts and social media, is general in nature and is not personalised advice for your specific situation.

Refusal or Discontinuation of Service

We're committed to providing our services professionally and ethically. We reserve the right to refuse or discontinue service if:

•      you don't comply with these Terms;

•      providing the service would be unlawful, unethical, or pose a risk to health or safety; or

•      we reasonably believe continuing would be inappropriate, unsafe, or contrary to our professional obligations.

Where practicable, we'll give you written notice of the reason.

Limitation of Liability and Indemnity

To the maximum extent permitted by law, and subject to any consumer guarantees that cannot be excluded under the Australian Consumer Law:

•      Quadrants of Health's total liability for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim.

•      We are not liable for any indirect or consequential loss, including loss of profit, opportunity or goodwill, arising from your use of our recommendations.

•      You agree to indemnify Quadrants of Health against any claim, loss or damage arising from your failure to disclose relevant health information, your failure to follow safety-relevant guidance we provide, or your misuse of any resource or product outside its intended purpose.

•      If you breach these Terms, or we incur a liability arising from your use of our services, you agree to cover the reasonable costs we incur as a result, including legal fees.

We don't take on additional contractual liability beyond what the law would already impose on us, since our insurance is written on that basis and a broader promise could fall outside cover.

Dispute Resolution

•      If you're unhappy with any aspect of our service, please contact us directly first.

•      If a concern can't be resolved directly, either party may refer the matter to an independent mediator before pursuing other action.

•      As an ATMS member, complaints about professional conduct may also be raised with ATMS through its complaints process.

•      You agree to cooperate with us, at your own cost, in handling any dispute, complaint or investigation connected with your use of our services, including one that arises from incomplete or inaccurate information you've given us.

•      These terms are governed by the laws of New South Wales, Australia.

Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will always be available on this website, and continuing to use our services after an update means you accept the revised terms.
